Significant Limitations on Pre-Dispute Arbitration Agreements

President Barack Obama signed the Fair Pay and Safe Workplaces Executive Order (“Executive Order”), which obligates most federal contractors and subcontractors to disclose labor law violations, to provide employees with detailed information about their paychecks, and limits the circumstances under which certain claims may be arbitrated. Employers with federal contracts or subcontracts for supplies or services valued in excess of $1 million (but excluding contracts or subcontracts solely for the purchase of commercial items or commercially available off-the-shelf items) are now prohibited from entering into agreements with employees or independent contractors to arbitrate claims arising under Title VII, or any tort relating to sexual assault or harassment, unless the agreement is made with the employee’s or independent contractor’s voluntary consent after the dispute arises.  The Executive Order additionally requires that employers incorporate this requirement into any subcontracts similarly exceeding $1 million. Ninth Circuit Court of Appeals

Court Invalidates Independent Contractor Agreements

An article by Todd Lebowitz, posted at www.mondaq.com, tells of a court decision that may be of interest to those in the field services business. In Todd’s words: “The decision shows the lengths to which courts will go to invalidate independent contractor agreements, including rejecting the parties’ contractual agreement to apply Georgia law, which would have weighed more heavily in favor of independent contractor status.” The article starts:

“Delivering another blow to the independent contractor model, the Ninth Circuit Court of Appeals held this week that furniture delivery drivers for Affinity Logistics were employees under California law, not independent contractors. In Ruiz v. Affinity Logistics Corporation, the Court of Appeals rejected the district court’s conclusion that Affinity’s drivers were independent contractors, a decision the district court had reached based on the fact that the drivers had established their own businesses, obtained their own Employee Identification Numbers, signed independent contractor agreements, and could hire helpers or secondary drivers. The Ninth Circuit instead ruled that other factors were more important to the analysis and that California law required the conclusion that they were employees of Affinity. Continue Reading

Field Service Rep Receives Police Escort Off Property

Before noon today, a mortgage field services rep thought he was getting the royal treatment when he contacted the security / maintenance office of a prestigious condo complex. As he has always done in the past, he phoned ahead for permission to enter the gated complex and was told that someone would meet him at the gate. To his surprise, he was met by a local law enforcement officer that questioned him about the purpose for his visit and what he may know of any of the occupants in the complex. The field rep’s work order and call-back letter was sufficient explaination for the officer which advised the rep there was an ongoing murder-suicide investigation and he was prohibited from entering the area. The 80-20 rule – nonchalantly mentioned, most often misunderstood, greatly overused and lacking the credit it deserves, in my opinion, as one of the laws of the universe. The 80-20 rule is also known as the Pareto principle, the principle of factor sparsity and the law of the vital few. A business consultant by the name of Joseph Juran named the 80-20 rule after an Italian economist Vilfredo Pareto. Pareto was the guy that publicized the fact that 80% of the land in Italy was owned by 20% of the population. Licensing For Property Preservation Contractors

Comments in groups are trending toward discussions of restricting numbers of contractors in certain areas and the licensing of contractors. I can’t say much on restricting numbers but maybe I can help with the licensing issue. What most contractors do not realize is that licensing and enforcement is probably already in place in your city, county or state.
