Please visit the Contractor Database and note the changes to the information on that page.  The most recent changes are always in red lettering.

We have finished copying the contractor information from the contractor database to the state page for each contractor.  This will allow visitors to Cubic Yard to go to one page – the state page – to see the regulations, pertinent links and contractors.

At least half of the contractor database entries could not be copied because the narrative given did not include a location.  Many did not contain areas worked.  If you would like for your business to be included on the state page for your state you can put in another updated ad and we will remove the old.

If your database entry has not shown up yet, it is because we wanted to move the existing contractor records before placing the new entries in the database.  If you have submitted a database entry in the last 7 days or so it is probably in the stack we will begin working on.  There are probably a couple of dozen entries so give us a few more days.

 

 

I am in the process of retrieving all of the contractor ads that have been placed on CubicYard in the past posts.  These ads will be copied to the state specific pages so that there will be an even better chance of contractors being found by searchers.

This means that contractors now have as a minimum the following ways to get free advertising and exposure on CubicYard:

  • The contact information the contractor posts by using the "Free Advertising" link.
  • The new contractor database
  • Contractor contact information added to the state pages

I hope you are taking advantage of these opportunities.  You should be putting in a post at least monthly and you should put your company information in the contractor database.  The small staff here at CubicYard will take care of putting your information on the state specific pages.  It might be time for contractors to consider sending a new ad specifically for the state pages.  Use the contact page for information on sending the ads.

Ahh, baseball.  America’s favorite pastime.  Or is it?  I’m thinking America’s new favorite pastime is “sticking it to the little guy”.  To make sticking it to the little guy really ugly, baseball terminology is being used.  I don’t know if that’s illegal, blasphemy, deceptive or just plain stupid but anyway, let’s take a look at one company’s “Three Strikes Action Plan”.  Of course I will add my comments as we go along.

Strike 1
It’s not a fast ball or curve ball that can give you your first strike.  There’s a couple of new pitches that start the countdown:

  1. Not properly following work order instructions
  2. Risk issues
  3. Falsified reports

What’s the repercussions of having one strike against you?  Well, you will get counseling and or a verbal warning.  I really suspect it will be both – the counseling and the verbal warning – these are intended to help you find ways to improve the quality of your work.  You will be subjected to this unlicensed and unqualified counseling for a period of 30 days.

By the way; if the company gives you the wrong address on the work order and you discover that fact and do not perform the requested services, do you get a strike?  If you take the strike 1 rules literally then I see no way around it.

Risk issues?  Well, bud, might as well go ahead and count one strike against you when you leave the house in the morning.  Not only are these risk issues unidentified but we all know the risk we take by just walking out the door in the morning.

Falsified reporting.   Hmmm.  They probably mean that you don’t tell the truth on the report.  It’s not specifically stated, but I imagine being forced to choose from the answers they put in their online forms is excused.  We all know you cannot proceed to completion of the form unless some answer is given from their predetermined choices.

Strike 2

Let’s not get to anxious now.  We only have one strike against us.  The bases are loaded:  mom is on third base and the kids are anxious to run all the way home from 1st and 2nd base.  Which pitch are we going to get.  Well, in addition to the pitches coming at us from the strike 1 group, we now have:

  1. Having more than 1% of your work orders past due.
  2. Having more than 1% of your work orders returned for redo or clarrification or …
  3. Evidence of table topping

Okay.  What kind of trouble are we in now with 2 strikes against us?  First, you must attend mandatory training.  You can also kiss any bonuses bye-bye.  And, you will probably suffer an increased discount fee!

Mandatory training!  By management?  Boy, this sounds exciting.  You’re finally going to get some training!  Do not concern yourself that the instructor has never held a hammer before and couldn’t cover a pool if his life depended on it.  Heck, it’s free!  By the way, as soon as you get your class schedule, pop off a copy of The IRS Form SS-8 to the IRS and get their determination on your independent contractor status.  You may wind up with back pay owed you!

The threat of loosing bonuses are probably to no concern to any of us.  Most contractors would be happy if they were paid their invoice amounts.  In fact, if we were paid what is taken away on a regular basis that’s as good as a 25% bonus.

Now we come to table topping.  Probably no reason for contractors to even read this – just inspectors.  I don’t think this table topping thing is enforced that often.  As an example, after one of our worst hurricanes down here in Alabama, one of our companies decided to help us out – bless ‘em – they sent a company from out of the mid-west to work inspections in our area.  A couple of months after the storm, we were overrun with rechecks.  The pictures did not match, etc.  I don’t guess it’s important that we had never been to some of these properties before.  When it was all over with, I looked at all the rechecks for the properties we had never been to.  Guess what?  343 white frame houses and 701 red brick houses.  No brick/frame houses; no green houses; no two story houses – nothing but white frame and red brick.  If the company cannot recognize table topping with 1,044 examples in front of them, well .. like I said, I don’t think this is enforced too often.  After all, they have to meet their deadlines too!

I know you been setting there steaming mad about the 1st one:  having more than 1% of your work orders past due.  Well, cool off a bit.  I saved it for last on purpose.  They DO NOT count the work orders that were late when they sent them to you.  At least that’s what they say.

Strike 3

All right, go ahead and say it.  It just hasn’t been your year.  When you get another strike against you by swinging and missing any of the pitches in the strike 1 and strike 2 groups, well, it’s time for a reduction of your assignments or complete removal of all your zip codes from the all-knowing, infallible system.

Most companies state that this is a last resort to be used when all other means have been exhaused.  Really, I can’t believe you let it get this far!  Didn’t you get anything at all out of the counseling?

How does a contractor make money working for a National which so underpays its contractors and then takes 25%?

 

The problem truly magnifies itself when the national only pays $18.75 net per cubic yard for trash and debris removal while HUD is paying them $55! You cannot even load the trash and debris for $18.75, much less pay to have it properly disposed of.

Some national companies only pay a net of $112.50 for Initial Maid Service which includes a “Maids Checklist” that must be filled in, signed and uploaded to them.  There is no way to even “Re-Fresh Maid” at $112.50 with the cost of labor, insurance, fuel, etc and make any money.  Can you imagine trying to do an Initial Maid Service for $112.50 in one of these pigstys.

When you call the national’s office for an increase the national says, NO, as they have given their clients a CTG (Cradle to Grave) price. So what!!!!   The national should equally take care of its Contractors! No Way.  They find ways to further discount or disallow charges on your invoice.

Management and Marketing (M&M) Contractors market and manage single-family properties owned by, or in the custody of the Department. HUD-owned houses are often referred to as HUD Homes. These are homes that had an FHA-insured mortgage and the homeowners defaulted. The lender then deeded the home to the Secretary of HUD in exchange for an insurance claim payment.

The contractors listed below perform management and marketing tasks. Mortgagees must ensure that all appropriate procedures, processes, letters, and other appropriate documents identify the respective M&M contractor for a given state, for each of the following areas:

1. Occupied conveyance procedures.

2. Preservation and protection issues such as requests to exceed maximum allowable limits, demolition notices issued by cities or states, etc.

3. Filing of claims. In addition to mailing the claim forms, title evidence, keys, etc. to the contractors, notify the contractor via electronic mail of the property conveyance on the date the deed is filed for record.

4. Extensions of time for conveying title to HUD and for submitting title evidence, fiscal data (Parts B, C, and D of the form HUD-27011) and supplemental claims on conveyances.

5. Title Evidence for conveyances on or after the effective dates identified below that includes the deed and title insurance information.

6. Conveyance of damaged properties.

In addition to the above areas identified, mortgagees are instructed to send all routine correspondence to the M&M contractors identified on this page.

Bad Address Research

There are times when locating a property is extremely difficult and time consuming.  Fortunatly, most property preservation contractors receive their work orders for properties  that have been located and inspected by an independent contractor working for a mortgage servicer.  Property preservation contractors probably receive a good, valid address for over 90% of their assignments but it is imperitive that contractors recognize they are assuming responsibility for servicing the correct property regardless of the information they receive.  It would be a smart business decision to confirm all information concerning the property before any work is started.  The more professional contractors may confirm all information before leaving their office.

The normal procedure for the majority of preservation contractors is to load the equipment on the truck and take off for the property.  However, let’s see if we can’t establish some operating procedures which can save time and money and is sure to decrease the probability of charge-backs, litigation and lots of aggravation.

All property addresses should be verified with your local taxing authorities.  In most instances property information will be recorded in the county seat court house.  More and more of these records are available on the internet but if you operate in an area which has not put their records online, you could save yourself some time by finding the court house employees who can help you by telephone and also finding the professional records researcher that charges a fee for finding your information.  Contractors will seldom actually need to go to this level of verification but if it can be done with little expense and time, it would go a long ways towards protecting your business from accusations of sub-standard preliminary research.

A good starting point for all preservation contractors is http://publicrecords.netronline.com.  Quoting from this site’s home page ”
The Public Records Online Directory is a Portal to official state web sites, and those Tax Assessors’ and Recorders’ offices that have developed web sites for the retrieval of available public records over the internet”.  So there you go; a totally free directory of all known sites containing tax records.  Phone numbers and contact information are listed for the record keepers that do not yet have their records online.

Property preservation contractors as a whole are becoming much more professional and are taking advantage of the technology that does benefit the industry.  Once the contractor has confirmed owner of record, property address, description of property and any other useful information from the tax records, it is quite possible that http://earth.google.com will let you stroll down the street and visit the property before you even leave your office.  Google Earth describes itself with this taken from their home page: “Google Earth lets you fly anywhere on Earth to view satellite imagery, maps, terrain, 3D buildings and even explore galaxies in the Sky. You can explore rich geographical content, save your toured places and share with others”.

With all the technological tools available to contractors today, there are not many good excuses left for working on the wrong property.

 HUD regulations dictate a quality control plan which would review work performed by service contractors:

In accordance with 24 CFR, Part 202.5(h) all FHA approved Servicers are required to implement a written quality control plan covering all aspects of loan origination and servicing and to conduct regular quality assurance reviews in accordance with the plan. Servicing quality control plans should incorporate quality assurance reviews of preservation and protection responsibilities including a review of work performed by third party field service contractors and other vendors.

The regular quality assurance reviews are intended to reveal contractors’ work that actually causes more damage than it is intended to prevent:

♦ Why remove the screws from the sheet rock covering the water heater in a mobile home when the sheet rock can be easily ripped off?
